These Terms of Service ("Terms") govern your use of the NetMind service, which is run by an independent developer based in Tunisia ("we", "us"). NetMind is not a registered company. By creating an account or using NetMind, you agree to these Terms. If you do not agree, do not use the service.
1. Acceptance of Terms
By accessing or using NetMind, you confirm that you are at least 18 years of age, have the authority to bind yourself or your organization to these Terms, and have read and understood our Privacy Policy.
2. Description of Service
NetMind is an AI-powered network management service for small businesses. It includes a desktop app for Windows and Linux, a web dashboard, and a REST API. Features vary by plan.
3. Accounts and Security
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately of any unauthorized access to your account.
- One account per person or organization, unless explicitly agreed otherwise.
- You may not share your account with third parties.
- We reserve the right to require you to reset your password if we suspect a security compromise.
4. Acceptable Use
You agree not to:
- Use NetMind for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to reverse engineer, decompile, or extract source code from the NetMind agent or service.
- Use automated scripts to access the service in a way that places excessive load on our systems.
- Resell, sublicense, or otherwise transfer access to the service without our written consent.
- Use the service to monitor or intercept the content of others' communications without authorization.
- Use NetMind on a network you do not own or are not authorized to manage.
5. Subscription and Billing
- The Paid plan costs $20 (70 DT) per month. You pay in advance for one or more months — by local payment in Tunisia or by PayPal — and the plan is activated once we receive the payment.
- Payments do not renew automatically. When the period you paid for ends, your account returns to the Free plan unless you pay for another period.
- You may cancel at any time from the Billing page in your dashboard. The Paid plan stays active until the end of the period you paid for.
- We may change prices with at least 30 days' notice. New prices apply only to periods you have not yet paid for.
- Refunds are provided on a case-by-case basis at our discretion, except where required by law.
- The free plan is provided without charge and may be changed or discontinued with reasonable notice.
6. Data and Privacy
We process your personal data in accordance with our Privacy Policy. You retain ownership of your data. You grant us a limited license to process your data solely to provide and improve the service.
You can permanently delete your account and all associated personal data at any time from your account settings (Danger Zone → "Delete my account"). Deletion is immediate and permanent.
7. Intellectual Property
NetMind, its software, trademarks, and underlying technology are owned by us. Nothing in these Terms transfers any ownership rights to you. You may not use our name, logo, or trademarks without our prior written consent.
8. Service Availability
We aim for high availability but do not guarantee uninterrupted or error-free access. We may perform scheduled or emergency maintenance at any time. We will provide advance notice for scheduled maintenance where practicable.
9. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will meet your specific requirements, be secure, or be free of errors.
10. Limitation of Liability
To the maximum extent permitted by applicable law, NetMind's total liability for any claim arising out of or relating to these Terms or the service is limited to the total amount you paid us in the 12 months immediately preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
11. Termination
- You may close your account at any time from account settings.
- We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.
- Upon termination, your right to use the service ends immediately. Data deletion follows the timeline in our Privacy Policy.
12. Governing Law and Disputes
These Terms are governed by the laws of Tunisia. If you live in another country, you keep any mandatory consumer protections of your local law. We will always try to resolve a disagreement informally first — just contact us. Disputes that cannot be resolved informally will be handled by the competent courts of Tunisia, unless your local law gives you the right to go to your own courts.
13. Changes to These Terms
We may update these Terms from time to time. We'll notify you of material changes via email or a notice in the dashboard at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
